1. Introduction

BYB Media LLC, doing business as BackYardBoyz ("BackYardBoyz," "we," "us," or "our"), provides the Services for educational and informational purposes only. By accessing or using our website, training platform, coaching, community, and related services (collectively, the "Services"), you agree to these Terms of Service ("Terms") and all applicable laws.

1.1 What BackYardBoyz Is / Is Not

2. SMS / Text Messaging Terms

By providing your mobile phone number and opting in, you consent to receive recurring SMS messages from BackYardBoyz.

Messages may include appointment confirmations, appointment reminders, account and support notifications, and promotional or marketing offers related to our programs.

2.2 Message Frequency

Message frequency varies based on your activity and your interactions with us.

2.3 Message & Data Rates

Message and data rates may apply, depending on your mobile carrier and plan.

2.4 Opt-Out

You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a confirmation message and no further messages unless you opt in again.

Mobile carriers are not liable for delayed or undelivered messages.

3. Educational Service; Use at Your Own Risk

You are solely responsible for your own decisions, conduct, transactions, and outcomes, and for ensuring that your activities — including any purchase, reconditioning, titling, or resale of vehicles — comply with all applicable federal, state, and local laws and licensing requirements.

BackYardBoyz does not guarantee income, profit, sales results, or business success. Any financial examples, testimonials, case studies, or projections are illustrations of individual experiences for informational purposes only and are not typical or guaranteed. You agree that you do not rely on any BackYardBoyz statement as a guarantee of results.

5. Eligibility

The Services are intended for individuals 18 years of age or older. By using the Services, you represent that you are at least 18 and able to enter into a binding agreement.

6. Payments & Refunds

Pricing and tier inclusions are described at the time of enrollment and may change. Refund eligibility, if any, will be described at the point of sale or in a separate cancellation policy. You agree to manage your subscription or enrollment through the platform designated at checkout, and that accessing the training, coaching, or community constitutes delivery of the product for the purpose of any payment dispute.

7. Intellectual Property; Limited License

All Content — including training videos, scripts, frameworks, checklists, templates, coaching materials, and branding — is the property of BackYardBoyz and protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable license to access the Content for your personal, non-commercial use. You may not copy, distribute, resell, sublicense, or create derivative works from the Content, or use it in a competing program. Unauthorized use terminates your license immediately.

8. Acceptable Use

You agree not to: post unlawful, infringing, or deceptive content; misrepresent your affiliation with BackYardBoyz; probe or disrupt our systems; scrape or harvest data without permission; or use the Services in violation of any law. You are solely responsible for content you post in community features.

9. Third-Party Services

The Services may reference third-party tools, platforms, or websites for convenience. These are independently operated, and BackYardBoyz is not responsible for their content, performance, security, data handling, or compliance. Use of any third-party service is at your own risk.

10. Indemnification

You agree to indemnify and hold harmless BackYardBoyz and its representatives from any claims, losses, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, BackYardBoyz is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill. Our total liability shall not exceed the amount you paid us in the three (3) months preceding the event giving rise to liability.

12. Dispute Resolution; Arbitration

Any dispute arising out of these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, on an individual basis. You and BackYardBoyz waive any right to participate in a class or representative action. Either party may proceed in small claims court for qualifying claims. Any claim must be filed within the time permitted by applicable law.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which BackYardBoyz operates, without regard to conflict-of-law principles.

14. Changes to These Terms

We may modify these Terms at any time by posting an updated version. Continued use of the Services after changes constitutes acceptance. If you do not agree, you must discontinue use of the Services.
